This document contains 20 legally binding clauses that govern your use of the Brandcey ecosystem. Please read them carefully.
By accessing and using the Brandcey platform, you explicitly agree to be bound by this Terms of Service. If you do not agree to every single provision of this document, you must immediately cease use of the platform and delete your account.
In this document, "Brandcey", "we", "us", and "our" refer to the platform operators. "User", "you", and "your" refer to any individual or entity accessing the platform. All capitalized terms not defined herein have the meanings assigned to them in our master Terms of Service.
You must be at least 18 years of age or the age of majority in your jurisdiction to agree to this Terms of Service. By agreeing, you warrant that you possess the legal authority to enter into binding agreements.
Brandcey reserves the unilateral right to update, modify, or replace this Terms of Service at any time. We will provide notice of significant changes, but it is your responsibility to review this document periodically.
This Terms of Service shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions. Any disputes must be resolved in the state or federal courts located within Delaware.
To the maximum extent permitted by law, Brandcey shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your reliance on or use of this Terms of Service and the associated platform features.
You agree to indemnify, defend, and hold harmless Brandcey, its affiliates, and their respective officers, directors, and employees from any claims, damages, or expenses arising from your breach of this Terms of Service.
If any provision of this Terms of Service is found to be unenforceable or invalid by a court of competent jurisdiction, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
This Terms of Service, along with our Privacy Policy and other referenced documents, constitutes the entire agreement between you and Brandcey regarding the specific subject matter discussed herein.
Brandcey's failure to enforce any right or provision of this Terms of Service will not be considered a waiver of those rights. Any waiver must be in writing and signed by an authorized representative.
You may not use Brandcey to engage in fraud, impersonation, spam, harassment, or off-platform payment solicitation. Sharing private contact details (phone numbers, external payment links, WhatsApp handles) in pre-contract messages to circumvent platform payments is a bannable offence. We use automated detection and manual review to enforce this.
Brandcey charges a transparent platform fee on each completed milestone, displayed clearly at checkout based on user tier (Freelancer, Brand, or Agency). All payments are processed via Razorpay and held in escrow until milestone approval. Brandcey does not hold funds beyond the approved release period. Disputes over payment must be raised within 7 days of milestone delivery.
All creative work delivered through a completed, paid contract belongs to the client upon full payment release from escrow, unless a separate licensing agreement is signed between both parties. Freelancers retain the right to display completed work in their Brandcey portfolio unless the client explicitly requests confidentiality at the time of contract creation.
If a dispute arises between a client and freelancer, both parties must first attempt resolution through Brandcey's in-platform mediation tool within 14 days. If unresolved, Brandcey's support team will review submitted evidence and make a binding decision on escrow release. Brandcey's decision is final for disputes involving amounts under โน50,000 / $600 USD.
Brandcey reserves the right to suspend or permanently terminate any account that violates these Terms. In cases of fraud, repeated policy violations, or chargebacks, accounts will be terminated without prior notice. Users may appeal termination decisions by contacting support within 30 days. Any pending escrow funds at the time of termination will be reviewed and released or refunded per our refund policy.
By uploading portfolio items, profile descriptions, or messages to Brandcey, you grant us a non-exclusive, royalty-free licence to display that content on the platform. You retain full ownership of your content. You are solely responsible for ensuring that any content you upload does not infringe on third-party intellectual property rights or violate applicable laws.
Brandcey collects and processes personal data in accordance with our Privacy Policy. We use your data to operate the platform, process payments, verify identity, and improve our services. We do not sell your personal data to third parties. KYC documents are stored securely and accessed only for verification purposes by authorised team members.
Brandcey is currently in closed beta. Features may change, be paused, or be removed without notice during this period. While we take every measure to protect your data and funds, we cannot guarantee uninterrupted service. By participating in the beta, you acknowledge this and agree not to hold Brandcey liable for service interruptions or feature changes during the beta period.
By creating a Brandcey account, you consent to receive transactional emails (payment confirmations, contract updates, dispute notifications) and, optionally, product updates and newsletters. You may opt out of marketing communications at any time from your account settings or by clicking unsubscribe in any email. Transactional emails cannot be opted out of while your account remains active.
